Acceptable Use Policy
How clients and their end users may use the services Movalo provides. Incorporated into the Master Services Agreement (MSA) between Movalo LLC and the Client.
1. Introduction.
This policy is incorporated into the Master Services Agreement (MSA) between Movalo LLC ("Movalo") and its Client. It governs the use of all services, systems, networks, and products provided by Movalo (the "Services").
The policy protects the integrity, security, and reliability of Movalo's network and those of its clients and partners. Use of the Services constitutes acceptance of this policy. Clients are responsible for ensuring that their employees, contractors, and other end users comply with it.
2. Prohibited uses.
Clients and end users may not use the Services for illegal, fraudulent, or infringing purposes, or for any activity that could harm the Services, Movalo, or others. Prohibited activities include the following non-exhaustive categories.
2.1 Illegal and fraudulent activities.
- Violating applicable laws or regulations, including HIPAA, GDPR, and export-control laws.
- Engaging in fraud, phishing, pharming, or impersonation.
- Storing, transmitting, or distributing illegal material.
2.2 Infringement of intellectual property rights.
- Using the Services to infringe patents, copyrights, trademarks, or trade secrets.
2.3 Network and system abuse.
- Distributing malware, viruses, or destructive code.
- Launching denial-of-service attacks.
- Attempting unauthorized access or system interference.
- Network scanning without prior written consent.
- Unauthorized data monitoring or interference with the Services.
2.4 Email and communication abuse.
- Sending unsolicited bulk or commercial email.
- Forging email headers.
- Harvesting email addresses without consent.
- Transmitting harassing, defamatory, threatening, or obscene material.
3. Content responsibility.
Client is solely responsible for all content stored on or transmitted through the Services.
4. Enforcement and violations.
Where Movalo determines that a violation has occurred, Movalo may take one or more of the following actions, in its reasonable discretion and consistent with the MSA: issue warnings, suspend or terminate access, remove or quarantine content, block traffic, report to law enforcement or other authorities, and recover costs incurred as a result of the violation.
5. Reporting violations.
Suspected violations should be reported through our contact form with sufficient detail for us to investigate (the service affected, the nature of the violation, timestamps, IP addresses or accounts involved, and any supporting evidence).
6. Modifications.
This policy may be modified per the procedures set out in the MSA. The current version is published at movalo.com/aup.html.
