Terms of Use
These terms govern your use of the movalo.com website. Paid engagements are governed separately by the Master Services Agreement (MSA) that Movalo and the client sign.
1. Acceptance of these terms.
By accessing or using movalo.com (the "Site"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use the Site. These terms apply to the Site only. If you are a client of Movalo, services we deliver to you are governed by the Master Services Agreement (MSA) and any applicable Statement of Work (SOW), which control if they conflict with these terms.
The Site is operated by Movalo LLC, a Florida limited liability company with its principal place of business in Jacksonville, Florida.
2. Permitted use of the Site.
You may view, browse, and use the Site for lawful purposes, including learning about our services, contacting us, and accessing publicly available content. You may also fill out our contact, callback, and emergency forms when their stated purpose applies to you.
3. Prohibited use.
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law or regulation.
- Submit information you do not have authorization to submit, including impersonating another person, organization, or affiliation.
- Submit content that is fraudulent, defamatory, harassing, threatening, obscene, or infringes the intellectual property or privacy rights of others.
- Attempt to gain unauthorized access to any part of the Site, related systems, or our infrastructure.
- Interfere with the operation of the Site, including by scanning, probing, or testing for vulnerabilities without our prior written consent.
- Use automated systems (bots, scrapers, crawlers, AI agents) to extract data from the Site in volume or to circumvent the controls on our forms.
- Use the Site to distribute malware, conduct phishing, or otherwise harm Movalo, our clients, or third parties.
4. Intellectual property.
The Site and its contents, including text, graphics, photography, illustrations, code, logos, and the overall design and arrangement, are owned by or licensed to Movalo and are protected by US copyright, trademark, and other intellectual property laws. "Movalo" and the Movalo logo are trademarks of Movalo LLC. Other product and company names mentioned on the Site are the property of their respective owners and are used here for descriptive purposes only.
You may view and print pages of the Site for your own personal, internal, non-commercial reference. Any other use, including reproduction, modification, distribution, public display, or creation of derivative works, requires our prior written consent.
5. Forms, submissions, and communications.
When you submit information through our forms or contact us through the Site, you represent that the information is accurate and that you are authorized to provide it. We have no obligation to respond to any submission, and our response time and content are at our discretion. If you provide ideas, feedback, or suggestions, you grant Movalo a perpetual, royalty-free, worldwide license to use them without obligation. We will not, however, use any confidential information you provide for any purpose other than responding to your inquiry, and we treat all submissions per our Privacy Policy.
6. Third-party links and services.
The Site may contain links to third-party websites and services that we do not control or operate. We provide these links as a convenience. We are not responsible for the content, privacy practices, or operation of any third-party site or service, and a link from the Site does not constitute an endorsement.
7. Disclaimers.
THE SITE AND ITS CONTENTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MOVALO DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE INFORMATION ON THE SITE IS COMPLETE, ACCURATE, OR CURRENT.
Content on the Site, including service descriptions and technical material, is provided for general informational purposes only and is not legal, financial, tax, medical, or other professional advice. Consult an appropriate professional for advice specific to your situation.
8. Limitation of liability.
TO THE FULLEST EXTENT PERMITTED BY LAW, MOVALO, ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (USD 100). NOTHING IN THIS SECTION LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
If you are a client of Movalo, the limitation of liability in the MSA controls for the services we deliver to you, not this paragraph.
9. Indemnification.
You agree to defend, indemnify, and hold harmless Movalo and its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these terms or your unlawful use of the Site.
10. Modifications.
We may update these terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Site after we post changes constitutes your acceptance of the updated terms. If you do not agree to a change, stop using the Site.
11. Governing law and disputes.
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these terms or your use of the Site will be brought exclusively in the state or federal courts located in Duval County, Florida, and you consent to the personal jurisdiction of those courts. You waive any objection based on forum non conveniens.
12. Severability and entire agreement.
If any provision of these terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect. These terms, together with our Privacy Policy and (for clients) the MSA, are the entire agreement between you and Movalo regarding your use of the Site.
